Marketplace Terms and Conditions

INTRODUCTION

1 - These are the terms of use of our Marketplace on the Candide Platform. “Candide Platform” means the Candide App and all our websites, mobile sites, mobile apps, social media platforms or any other technology or mechanism you may use to interact with us. These Terms incorporate Candide’s General Terms and Conditions and Privacy Policy. The Candide Platform is operated by Candide Limited (“Candide”, we, us and our). We are a limited company, registered in England. Our registered company number is 9207044, and our registered office is at 40 Queen Square, Bristol BS1 4QP.
2 - We reserve the right to change these Terms from time to time by changing them on the Candide Platform, although no such change will affect any Sale Transaction you have already made with us. Your continued use of the Candide Platform and any new Sale Transactions will be bound by the new Terms.
3 - As a consumer, nothing in these Terms will affect or reduce your legal rights under UK law (your "non-excludable statutory rights").

THE SERVICE

4 - Our Service allows you to buy and sell garden items, plants and seeds in an easy way. You can find out more information about our Service and its features on our seller’s page.
5 - You can sell your items through our Service by posting pictures and a description of the item you want to sell via our marketplace (“Sale Item”). We reserve the right to edit the title, description, and image of your Sale Item to meet our commercial purposes and reflect our changing business needs (including but not limited to, ensuring that it adheres to our internal listing guidelines, as well as any requirements of our third party suppliers and/or partners).When a user of the Service purchases such Sale Item, this is a “Sale Transaction”.
6 - Your payments are processed by a third party payments processer, Stripe, and you must comply with Stripe’s applicable terms of use (currently available here) when using or making payments through the Candide Platform.
7 - To safeguard the interests of our users, you are not permitted to sell or purchase a Sale Item by making direct arrangements with the buyer or the seller to use a payment method other than the payment methods offered via the Service.
8 - We want our Service to be a positive experience for our users and we ask that you honour the commitments you make to another user in respect of the swap, sale or purchase of a Sale Item.
9 - Any agreement for and/or purchase of a Sale Item is made solely between you and the seller. The application may include functionality for suggesting more effective selling, such as discounting Sale Items, but sellers have, at all times, total discretion to set prices. Complaints, questions and claims related to a Sale Item should be directed to the seller.
10 - As we are not the seller of any Sale Items, we have no control and do not give any commitment relating to the existence, quality, safety, genuineness or legality of Sale Items, the truth or accuracy of any picture or description of the Sale Items or any other content made available by users, the ability of sellers to sell Sale Items, the ability of buyers to pay for them or that a buyer or seller will actually complete a transaction or return the Sale Item, and we have no liability in this respect. Sellers are responsible for ensuring that any age-restricted Sale Items are marked clearly with the applicable age restriction (as required by law) and buyers agree that they shall not attempt to purchase Sale Items if they are younger than the advertised and legal age restriction. For the avoidance of doubt, Sellers will also be responsible for providing complete and accurate descriptions of any Sale Items offered, dispatching purchased Sale Items promptly after receiving payment, and buyers will be responsible for making prompt payments for any purchased Sale Items.
11 - If you are the seller, you agree to comply with all applicable data protection and electronic marketing laws, when collecting and processing buyers’ personal data.
12 - If you are the seller, you agree: (i) not to hold yourself out to any third party (including any users) as being an agent, employee, partner or representative of Candide, or as otherwise having any authority to bind Candide or to make representations, or give any warranties, on Candide’s behalf; (ii) not to use the Candide Platform to market to any third parties including users; and (iii) to delete and cease use of any and all information, data and other such materials that you acquired from or in connection with the Candide Platform promptly upon ceasing to use the Candide Platform for the purposes of selling your Sale Items.

SHIPPING

13 - The seller is responsible for the shipment of the Sales Item to the buyer.

RESOLVING DISPUTES

Disputes with us
14 - If you have a dispute with us relating to the Service, in the first instance please contact us at support@candidegardening.com and attempt to resolve the dispute with us informally. Please note that, if you are a consumer, this is not your only remedy for a complaint or dispute and you are still entitled to any other statutory rights or remedies that may be available to you.
Disputes with other users relating to a Sale Transaction
15 - All purchases/sales made outside of the Candide platforms are against our Terms of Service
16 - If: a) as a buyer your Sales Item has not arrived, or if what you received is significantly not as described or faulty, or b) as a seller you are sent an unauthorised payment, or a buyer claims they didn’t receive their Sale Item, you can report the issue to us at support@candidegardening.com within 180 days and we will reply to you with instructions on how to proceed.
